Morning Session: Lynette Sharp

Identification Procedure Ruling (~8:25–8:40 AM)

Prosecutor Shawn Smith finished direct examination of Lynette Sharp. Key testimony:

Sharp described her communications with Ben Song after the July 4 incident. Song was hiding, dehydrated, and trying to reach a treeline near Highway 67 to be picked up. Sharp and Don Thomas (“Juniper”) picked Song up — he jumped into the back seat of the car instead of the planned trunk.
Song was taken to a “cat-sitting apartment” with no connection to him. Sharp brought him food, clothes, a wig, and head/face coverings. Song “put phones in the microwave” for security.
Song drew diagrams of the Prairieland buildings and described what happened: he and Joy Gibson were in a car; others were setting off fireworks near the fence; Evetts was popping tires with a knife; Baumann (“Bible”) was spray-painting cars; a guard went into the facility and “they were scared.”
Song told Sharp: “Then I shot him.” Sharp testified he said his gun jammed, he dropped it, and ran into the woods. He said he felt a burning in his leg (later attributed to a burst pepper spray canister, not a gunshot). He hid in sunflowers to avoid thermal detection from drones, became dehydrated and hallucinated, and “prayed to sunflowers.”
Song expressed regret: “If he could turn himself in and everyone else go, he would, but that’s not how it works.” He felt especially bad for Ines, Liz, and Savanna, who “didn’t know the plan.”
Song told Sharp he was “glad no one died.”
Song said he did not plan to be arrested again — this was a known sentiment of his, well known to Sharp.
Song described “suppressive fire” — fire to hold a group in a fixed position.
Sharp later met with Song, Susan Kent, and Rebecca Morgan (“Gardenia”) at a Tom Thumb parking lot. Song repeated his account. Morgan “felt lied to” — she didn’t know the plan. Sharp and Song parted ways; Song had a pistol in a holster under the coffee table and declined Sharp’s offer of another gun.
“Your actions saved my life” — Song to Sharp after she picked him up.

Cross-Examination: Defense (Beginning ~9:50 AM)

Sanchez Estrada’s attorney established quickly that Sharp did not know Des Sanchez Estrada — he was not in her affinity group, not in the Signal chat, not in the Emma Goldman Book Club (EGBC).

Phillip Hayes (for Ben Song) conducted the most extensive and effective cross-examination:

Sharp testified the defendants are all part of an LGBTQ segment of the left who “finally found community” and “could be themselves with each other.” Their affinity group was based on shared identity, not conspiracy.
“They think we are an organization called Antifa. That is not true.” Sharp does not consider herself Antifa but said she would be “disappointed in you if you’re not antifascist.”
The group met every Thursday — watched movies, read poetry. They did not have conversations about “overthrowing the government” or “shooting cops.”
Sharp described successful protests, including an 8-month campaign that drove out a homophobic church in Watauga.
The purpose of noise demonstrations: “To make noise and let people inside know we care” — “a little joy for people kidnapped and locked in a cage.” Song told Sharp detainees could see fireworks through slits in the wall.
Sharp described her plea deal coercion:
Given only 3 days to decide: plead to one count, or face a full indictment.
She didn’t write the plea document and didn’t have a chance to write it.
State prosecutors offered a deal to help locate Song; once Song was arrested, “Our deal is off! Our deal is off!”
First charge was accessory after the fact — a “very scary, confusing process.”
Sharp described jail conditions in Johnson County:
Takes 9 medications daily; facility provided inadequate medical care and staff “get angry” when asked for help.

Judge Pittman Intervenes

During Hayes’s cross-examination, as Sharp’s testimony became increasingly favorable to the defense, Judge Pittman excused the jury and asked whether Sharp’s attorney was present. Her lawyer raised her hand from the audience. Pittman said: “Don’t you want to talk to your client?” and repeated: “I think you should talk to your client.” The implication was clear to observers: Sharp was not cooperating with the prosecution as expected under her plea agreement. Sharp and her attorney spoke privately. After the break, Sharp’s tone was somewhat less emotional but she continued to provide testimony favorable to the defense. The jury was sent out and brought back in a second time during this episode.

Cross-Examination Continues (Post-Break)

Hayes (Song) continued:

Sharp has been protesting since 2020 — women’s rights, bodily autonomy/pro-choice, counter-protests against hate groups.
She has carried a concealed pistol to protests (legal). The intent was always defensive — an analogy to Cold War mutually assured destruction. Never took a weapon for offensive purposes, and no defendant she knows did either.
Training was not to fight police — it was for self-defense against people who might harm LGBTQ protesters.
First aid training: “Stop the Bleed” / “Halt the Hemorrhage” — mostly for dehydration, cuts, scrapes. SRA offered this training roughly monthly; “lots of groups do, including Boy Scouts.”
Black bloc: covering identity features (tattoos, hair) to prevent doxxing by counter-protesters. “Basically just anonymity” — not intent to harm.
Grey bloc: more casual concealment — sunglasses, covered hair.
SRA (Socialist Rifle Association): “Left-wing version of the NRA.” Went out of its way not to be a militia. “Legal and all about education.”
Signal chat used long before July 4, 2025; easy to miss things in long text streams.
Re August 2025 pre-plea interview: Sharp met with law enforcement 4–6 times. She sometimes added her “own twist” based on what she thought they meant — not lying, but interpreting. She initially thought Song might not have known someone was shot, but recalled he said “I shot him.” Later statement said “I shot at him.”
Joy Gibson, Song’s partner, is autistic and wears hearing protection for loud noises
Song said “I’m glad no one died” — Sharp took that to mean both officers and protesters.
“As far as you know, no one went there to hurt a police officer that night?” — “Correct.”
Faraday bags: Sharp made her own. “Something good to have in your inventory” (she corrected herself from “arsenal”). Not made with intent to commit crimes.
Signal texts about where to park, where to set off fireworks — “nothing nefarious.” She never saw fireworks at a protest before.

Cofer (Autumn Hill):

Not all defendants were in the SRA. Finn’s is a community center — skill shares, karaoke nights, potlucks, book swaps, plant swaps. Not connected to SRA.
Not all defendants attended range days. Sharp did not recall seeing Autumn Hill at range days.
EGBC is just a book club; not all defendants are members.
Defined political terms: socialism (“no one should be poor — not anti-American, we have social services”), communism (“no one can be wealthy”), anarchism (“no rule of law, government by the people, policing by the community — not chaos”), liberalism (“someone who believes the system can be reformed”). Sharp is not an anarchist.
Sharp is not a member of an organization called Antifa. “Affinity group” is not related to Antifa.
Signal “July 4th Party” chat: Sharp left the chat due to too much back-and-forth. She mentioned “plausible deniability” — referring to crimes like trespass and vandalism.
Sasha and Trap: unknown to Sharp, described as “pretty militant.” Neither went to Prairieland.
“Anti-Colonial Holy War” — a younger person, difficult and unpleasant to deal with, “they are why I left the chat.”
Ines (“N”/”Yen”/”DIS”) in Signal chat was trying to de-escalate, called noise demonstrations “pretty tame,” “dope,” “low risk.” Ines was also de-escalating “Anti-Colonial Holy War” specifically.
Shuttling/carpooling — “Would you agree it would be comically absurd to have a shuttle plan from an ambush?” — “Yes.”
Nathan Baumann (“Bible”) — no relationship with defendants before July 4; was anti-ICE.

Clayton (Maricela Rueda):

Rueda never came to range days — “she was afraid of guns, wouldn’t even touch the fake ones.”
Writing group: poetry. Nothing nefarious.
“Affinity group” means a close group of friends — “not a membership organization.”

Evetts’s attorney:

Sharp born 1968, now 57 years old.
Sleep deprivation, male guards, inadequate medical care, “problems with mental health” — all affected her ability to remember events from July.
“A lot of trauma — brain doesn’t work well.”
Under pressure to resolve her case; disagreed with factual wording in plea.
Facing state charges in addition to federal; state prosecutor present in front row.
15 years could be a life sentence for her. “Neither choice was good.”

Tolbert (Savanna Batten):

Maricela invited her to book club. Book club was not used to recruit to an “Antifa cell.” Topics: gender, racism, sexism. No recruitment.

Davis (Ines Soto) and Soto counsel:

Sharp told Ines about the protest only 2 days before — Wednesday before July 4.
Ines initially said he wasn’t going. Sharp was shocked they went — “they don’t normally do those things.”
Ines had discussed opposition to guns at protests. Sharp was shocked he had a gun in his car that night.
Song expressed regret that the Sotos were there.
A message attributed to Ines about “go over, under, around and through” was actually a quote excerpt from Our Enemies in Yellow — reading material for the next EGBC meeting, not his personal opinion.

Redirect: Prosecution (Smith)

Clarified that two prosecuting entities are involved: U.S. government (federal) and Johnson County (state). The state offered a deal to help locate Song. Sharp was “lumping agencies together” — “I never really knew who I was dealing with, very confusing.” FBI was who she thought she was talking to most of the time.
Read from plea agreement: Sharp agreed she was part of a group with “anti-fascist, anti-ICE, anti-government ideology which the government classifies as Antifa.”
“Too libby” means “too trusting in the government.”
Yellow vests: mediators between protesters and police.
Smith read from Signal chat, Exhibit 156: “Just heads up, fireworks are illegal, keep that in mind” (attributed to Song/Champagne).
Song made statements about rifles making police yield — referenced an incident in Austin, TX where protesters with rifles confronted police during a homeless encampment eviction. Sharp acknowledged Song “pointed [a rifle] at an officer” in Austin — used “offensively at police from what I recall.” (Note-taker CB records: “USAO = so, Mr Song has mentioned using a rifle in an offensive manner at police? correct.” Hayes objected; overruled.)
Smith asked about affinity group — Song introduced Sharp to the concept and said “this is my affinity group.”
De-arrest tactics: Smith pressed on whether it requires more protesters than cops. Sharp: “Maybe not” / “I don’t recall.”
Showed video (Exhibit 113) — “What is the shooter wearing?” — “Hearing protection.”

Black bloc photo (Exhibit 174, p. 70): Sharp identified the 3rd person from the left as Ben Song — “by build and hat.” Could not identify anyone else, including Liz Soto or Ines Soto.
Sharp had SRA training on treating gunshot wounds/loss of limb — “about once a month; lots of groups do, including Boy Scouts.”

Re-Cross (Defense, Brief)

Davis (Ines Soto): Clarified that the “Our Enemies in Yellow” quote attributed to Ines was reading material for book club — “not accurate to say it was his opinion.”

Hayes (Song): Song often acted as yellow vest / mediator at protests. Trained in de-escalation, self-defense, and firearm safety. Second rule of firearm safety: “You don’t point a gun at anyone you don’t intend to shoot.” (USAO objected — beyond scope of recross — sustained.)

Also noted: “I don’t think there is anyone who won’t concede fireworks are only shot at night” — Judge Pittman, apparently responding to the prosecution’s repeated emphasis on the nighttime nature of the protest.

Session ended at 12:05 PM for lunch.

Afternoon Session

Theresa Moynahan — ATF Firearms Trace Examiner (~12:55 PM)

Moynahan, a specialist at ATF Laboratories trained in forensic science, testified about examination of firearms and cartridge cases. She received 3 long guns (no Glock). She examined 11 cartridge cases and concluded they all came from the same firearm — the AR-15 with the binary trigger. Class, subclass, and individual characteristics were used for comparison. Brief testimony; no significant cross-examination noted.

Seth Sikes — Cooperating Witness (~1:40 PM)

Sikes, from Kennedale, TX (DOB 03-13-2003), pleaded guilty to providing material support for terrorism — no additional charges. His plea carries up to 15 years, possibly less based on cooperation. His factual resume was signed late October / early November 2025. He read it aloud: co-conspirators conspired for “acts of terrorism such as destruction of government property,” dressed in black, organized in “cells or affinity groups for Antifa,” planned “direct action” to influence or intimidate the government.

Direct Examination (Smith):

Met girlfriend Susan Kent in 2022 at a University of Arlington self-defense class; met Song there too.
Attended Song’s classes and SRA range days. Song “recruited” him into the SRA (Smith’s characterization).
Identified defendants: recognized both Sotos (met at community center), Savanna Batten, Maricela Rueda (met at community center), Zachary Evetts (met through self-defense classes, not at range). Knew of Sanchez Estrada as “an activist” but never met him. Knew Meagan Morris (at range day) and Autumn Hill (at social events, not range).
Song had several AR-15s. Range days involved shooting at targets resembling Klansmen, with binary triggers.
Who attended range days: Meagan Morris, Rebecca Morgan (once), Song. Not the Sotos, Batten, Rueda, or Autumn Hill. Sikes only attended 3–4 range days.
Song was primary instructor. Purpose of rifles at protests: “To display enough force to make cops back off. The sight of these rifles is intimidating.” Sikes was uncomfortable with this — “seems like a way to escalate a situation.”
Song described as “charismatic.” Smith asked: “Does he manipulate people?” Sikes: “Some people make that choice.”
Knew people mostly by Signal handles: Thomas = Grizzled, Gibson = Hemlock/Rowan, Song = Champagne, Evetts = John Bell John, Ines = En, Rueda = Beth/Marcella.
First heard about a daytime vigil, then a follow-up nighttime event in a secondary Signal chat (“4th of July Party”). Expected it to be larger — “make a ruckus, bullhorns, fireworks, regular demo.”
Invited by Song. Could not attend a “gear check” at Meagan and Autumn’s house.
Everyone involved has opinions on ICE — general disapproval. Sikes couldn’t say where most defendants sit politically, except: Song and Rueda identify as anarchists. Song identifies gender-wise as “somewhere in between, sometimes wears femme-presenting clothes.” SRA is a “very trans-inclusive organization.”
Sikes drove a black Honda CR-V, arrived at Prairieland solo. Put phone in Faraday bag (“OPSEC”). Everyone wearing black bloc. Song handed him a walkie-talkie (4–5 walkie-talkies total that night).
Song had difficulty pulling a cart up Tanglewood; Evetts was carrying a bag of firearms.
Set up fireworks near the fence/treeline — “from here, you can see inside the detention center, and they can see you.” Mortar-type fireworks used by Evetts and Sikes only. Sikes didn’t read the instructions — a mortar went off in his lap.
Nathan Baumann (“Bible”) introduced himself to Sikes at the protest (didn’t know him before) and showed off spray paint. Sikes did not use spray paint.
Rueda was using a bullhorn. Song had a very bright flashlight.
Sikes had an AR-15 broken down in his backpack — “in case there was a situation where self-defense or defense of another person was necessary.” Against counter-protesters, not police. “That seems to me to be a horrible risk to life.”
When Sikes saw increased officer activity and some officers leaving, he started telling everyone “we should leave” — including over two-way radios. Song was notified but didn’t respond. Some discussion about picking up fireworks trash before leaving.
The Sotos and Batten arrived late, after others.
Liz Soto left early, heading down Tanglewood.
As leaving, Song said “Get to the rifles.” Sikes’s impulse was to get out. He heard binary trigger fire, saw muzzle flash looking back. Song passed him running, “arms up at the ready,” repeating “oh shit, oh fuck” — then ditched his backpack. Sikes asked: “What did you do? Where are you going? What the fuck did you do?”
Song split off from the group. The Sotos, Rueda, Batten, and Sikes turned a corner and just started walking. Sikes walked past several officers who initially did nothing (surprising to him). He removed his mask; officers then turned around and told them to stop. They were arrested.
Gibson had left earlier — she wanted to see her partner. Smith: “Song just abandoned her?” “Song abandoned all of you, right?” Sikes: “Yeah.”

Cross-Examination (Defense):

Evetts’s attorney: Sikes never saw Evetts with any firearms. “From your understanding, what happened at Prairieland was not in the plan?” — “Yes, sir.” In his plea, Sikes said “Evetts is too nice to hurt anyone.” Evetts was not confirmed as an SRA member. A person called “Eagle” (real name unknown, on fringe of group) shouted “Happy 4th of July” during fireworks. “Relph” — not present at Prairieland but purchased the fireworks used.
Another defense attorney: Sikes had body armor and a broken-down AR-15 in his backpack. Rifle was intended as a deterrent. Wore black bloc to avoid being doxxed by right-wingers. His factual resume was written by the government — he “just signed the papers.” Both Sharp and Sikes confirmed their statements were written by others. Sikes acknowledged he told someone “I lie a lot.”
Clayton (Rueda): Brief questioning. Rueda made statements about not liking firearms.
Davis / Soto counsel: Sikes did not believe the Sotos were SRA members. Liz Soto left early down Tanglewood.
Tolbert (Batten): Did you all call yourselves “Antifa”? — “No, sir.” Savanna left early with the Sotos. Sikes was the only one in that departing group with a firearm.
Smith (redirect): Sikes wasn’t part of the planning and didn’t know what had been planned. Sikes is trained as a medic.

Sikes confirmed at least 2 other people were present who got away and were never identified — one called “Rose” and one known only by a personal nickname Sikes had given them. Total at the demonstration was approximately 13 people.

Lynette Sharp Testimony

The morning was all Lynette Sharp. They finished up a little of her direct exam, but then the cross examination became very powerful.

She’s been cooped up in jail for over six months in horrible conditions, under pressure from the prosecution. She was trying to give them the testimony they wanted and limit it to that on direct.

Cross Examination (Mr. Hayes, for Ben Song)

Hayes got a very powerful description of who these defendants are:

They’re all part of an LGBT segment of the left who felt somewhat alienated and really identified with each other
Their “affinity group” was based on that shared identity — not on some conspiracy
They’re not an Antifa organization. She’s not Antifa. She doesn’t consider herself Antifa, but is dissapointed in you if you’re not antifascist.
They’re a group of friends who share discussions and affection for each other and for their common point of oppression
The idea that they’re an organization called Antifa is not true

She more or less refuted a lot of what they had tried to get her to say in her plea deal and direct exam:

A lot of these people didn’t even know what the demonstration was going to be — fireworks, where to park, etc.
The people from the book club that she didn’t think were even going to go to the demo didn’t really have any idea what the plan was
Whatever the plan was, it wasn’t to shoot at cops — that was purely for self-defense
The book club and the SRA are two different things; they don’t necessarily overlap. Just because you’re in one doesn’t mean you’re in the other.
Inez is totally not a gun person — Lynette was shocked he had gone to the protest and had a gun in his trunk

She described the horrible conditions of the jail:

Plea Deal Details

She only had three days to decide: one count, or they’d indict her on a bunch of counts
She didn’t write it, didn’t have a chance to write it
State prosecutors were trying to do a deal if she’d turn in Ben Song; as soon as he got arrested, they said the deal is off

Judge Pittman Intervenes

At a certain point it was going so well for the defense that Judge Pittman stopped the proceedings and insisted that Lynette’s lawyer talk to her — clearly to try to get her to stick to her plea agreement and not tell the truth.

What he said:

“Don’t you want to talk to your client?”
Lawyer: “I will talk to my client.”
Judge repeated something like: “I think you should talk to your client.”

The implication was very clear to everybody: she’s not cooperating with the prosecution the way she’s supposed to; she’s helping the defense too much.

Lynette and her lawyer talked privately where no one else could hear.

After the break, the tone got a little less emotional — she had been getting worked up during Hayes’s questioning, and what she really feels was coming out — but she continued to pretty well tell the truth.
