- “Affinity group” means a close group of friends — “not a membership organization.”
Evetts’s attorney:
- Sharp born 1968, now 57 years old.

Hayes (Song): Song often acted as yellow vest / mediator at protests. Trained in de-escalation, self-defense, and firearm safety. Second rule of firearm safety: “You don’t point a gun at anyone you don’t intend to shoot.” (USAO objected — beyond scope of recross — sustained.)

Afternoon Session
Theresa Moynahan — ATF Firearms Trace Examiner (~12:55 PM)
Moynahan, a specialist at ATF Laboratories trained in forensic science, testified about examination of firearms and cartridge cases. She received 3 long guns (no Glock). She examined 11 cartridge cases and concluded they all came from the same firearm — the AR-15 with the binary trigger. Class, subclass, and individual characteristics were used for comparison. Brief testimony; no significant cross-examination noted.
Seth Sikes — Cooperating Witness (~1:40 PM)
Sikes, from Kennedale, TX (DOB 03-13-2003), pleaded guilty to providing material support for terrorism — no additional charges. His plea carries up to 15 years, possibly less based on cooperation. His factual resume was signed late October / early November 2025. He read it aloud: co-conspirators conspired for “acts of terrorism such as destruction of government property,” dressed in black, organized in “cells or affinity groups for Antifa,” planned “direct action” to influence or intimidate the government.
Direct Examination (Smith):
- Met girlfriend Susan Kent in 2022 at a University of Arlington self-defense class; met Song there too.
- Attended Song’s classes and SRA range days. Song “recruited” him into the SRA (Smith’s characterization).

- Set up fireworks near the fence/treeline — “from here, you can see inside the detention center, and they can see you.” Mortar-type fireworks used by Evetts and Sikes only. Sikes didn’t read the instructions — a mortar went off in his lap.
- Nathan Baumann (“Bible”) introduced himself to Sikes at the protest (didn’t know him before) and showed off spray paint. Sikes did not use spray paint.
- Rueda was using a bullhorn. Song had a very bright flashlight.
- Sikes had an AR-15 broken down in his backpack — “in case there was a situation where self-defense or defense of another person was necessary.” Against counter-protesters, not police. “That seems to me to be a horrible risk to life.”
- When Sikes saw increased officer activity and some officers leaving, he started telling everyone “we should leave” — including over two-way radios. Song was notified but didn’t respond. Some discussion about picking up fireworks trash before leaving.
- The Sotos and Batten arrived late, after others.
- Liz Soto left early, heading down Tanglewood.
- As leaving, Song said “Get to the rifles.” Sikes’s impulse was to get out. He heard binary trigger fire, saw muzzle flash looking back. the guns to shoot at others. When he heard gunfire, he was
running down Tanglewood + looked back + saw muzzle flash,

Lynette Sharp Testimony
The morning was all Lynette Sharp. They finished up a little of her direct exam, but then the cross examination became very powerful.
She’s been cooped up in jail for over six months in horrible conditions, under pressure from the prosecution. She was trying to give them the testimony they wanted and limit it to that on direct.
Cross Examination (Mr. Hayes, for Ben Song)
Hayes got a very powerful description of who these defendants are:
- They’re all part of an LGBT segment of the left who felt somewhat alienated and really identified with each other
- Their “affinity group” was based on that shared identity — not on some conspiracy
- They’re not an Antifa organization. She’s not Antifa. She doesn’t consider herself Antifa, but is dissapointed in you if you’re not antifascist.
- They’re a group of friends who share discussions and affection for each other and for their common point of oppression
- The idea that they’re an organization called Antifa is not true
She more or less refuted a lot of what they had tried to get her to say in her plea deal and direct exam:
- A lot of these people didn’t even know what the demonstration was going to be — fireworks, where to park, etc.
- The people from the book club that she didn’t think were even going to go to the demo didn’t really have any idea what the plan was
- Whatever the plan was, it wasn’t to shoot at cops — that was purely for self-defense
- The book club and the SRA are two different things; they don’t necessarily overlap. Just because you’re in one doesn’t mean you’re in the other.
- Inez is totally not a gun person — Lynette was shocked he had gone to the protest and had a gun in his trunk
She described the horrible conditions of the jail:
- No medical care
- They’d get angry at you if you asked for it
- Can’t get sleep
Plea Deal Details
- She only had three days to decide: one count, or they’d indict her on a bunch of counts
- She didn’t write it, didn’t have a chance to write it
- State prosecutors were trying to do a deal if she’d turn in Ben Song; as soon as he got arrested, they said the deal is off
Judge Pittman Intervenes
At a certain point it was going so well for the defense that Judge Pittman stopped the proceedings and insisted that Lynette’s lawyer talk to her — clearly to try to get her to stick to her plea agreement and not tell the truth.
What he said:
- Excused the jury
- “Does she have a lawyer here?”
- Lawyer raised her hand from the audience
- “Don’t you want to talk to your client?”
- Lawyer: “I will talk to my client.”
- Judge repeated something like: “I think you should talk to your client.”
The implication was very clear to everybody: she’s not cooperating with the prosecution the way she’s supposed to; she’s helping the defense too much.
Lynette and her lawyer talked privately where no one else could hear.
After the break, the tone got a little less emotional — she had been getting worked up during Hayes’s questioning, and what she really feels was coming out — but she continued to pretty well tell the truth.
