Narrative Summary

Morning Session: Kyle Shideler (Redirect and Re-Cross) and FBI Agent Justin Killian

Kyle Shideler — Prosecution’s “Antifa Expert” (Redirect)

The morning began with continued redirect examination of David Kyle Shideler from the Center for Security Policy. Prosecutor Shawn Smith had the witness read aloud from paragraph 4 of the indictment and Section 1 of the September 22, 2025 executive order, both defining Antifa as a “militant enterprise” that “explicitly calls for the overthrow” of the U.S. government. The defense objected that the executive order was issued after the alleged events, but Judge Pittman overruled.

Shideler testified that Susan Kent had identified Song, the Sotos, Batten, Sharp, and Sikes as Antifa members, and noted that while Sikes did not identify himself as Antifa, Kent (who was in an intimate relationship with Sikes) identified him as such.

The prosecution introduced the Antifa: The Anti-Fascist Handbook by Mark Bray (Exhibit 174, p. 19) and established that some proceeds from the book were donated to the International Antifa Defense Fund, which provides funds for trial defense, security upgrades, and relocation of Antifa members. Exhibit 207, the International Antifa Defense Fund website, was shown describing support for the Prairieland defendants, including an article calling ICE agents “gestapo” and titled “Showdown in Alvarado.” The Fund had contributed $5,050 to the GiveSendGo crowdfund, which had raised $76,407 total.

Smith then walked through the Emma Goldman Book Club (EGBC) Twitter feed (Exhibit 188), which had approximately 19,100 followers. Posts shown included: advertising the “Our Enemies in Yellow” zine discussion at Finn’s Place (June 30, 2025 — the last post before July 4); a de-arrest primer; posts about Palestinian solidarity encampments; burning police cars in Portland; “each de-arrest is a micro intifada”; “We don’t need safety, we need to escalate” (2024); a burning building referencing the “George Floyd uprising”; zines and stickers matching those found at the Soto residence; a Bash Back post (“I don’t bash back, I shoot first”); and a May 2023 post linking to an Antifa DFW Twitter account with a video titled “How to handle fash in your hood.”

A sticky notepad found at the Soto residence contained passwords for the EGBC Twitter and Antifa DFW Twitter accounts (Exhibit 79, pp. 78–79).

The defense objected to showing every video and link from the admitted Twitter feed. Judge Pittman noted he “tend[ed] to agree” and said Smith had “gone way beyond redirect” with “45 minutes of new material.” However, the judge ultimately overruled the objection, stating the defense had “mocked” the expert’s open-source material during cross and “opened the door.” The judge also commented: “The government is at a disadvantage because there are 18 other attorneys opposing them.”

A 2016 video (reposted in 2023) was played showing a street confrontation between individuals with far-right/neo-Nazi symbols and individuals wearing black bloc with anarcho-communist flags. Shideler characterized it as the leftist group “pushing [the far-right] out of the area” and using a flag as a weapon.

Kyle Shideler — Re-Cross Examination

Multiple defense attorneys conducted re-cross:

Attorney Cofer (Autumn Hill): Established that the September 2025 executive order was issued two months after July 4 and represents a policy direction from the president that would influence investigation priorities. Established that Sikes did not identify as Antifa. Raised that Mark Bray, author of the Antifa Handbook, left the country after receiving death threats — “open source comments online had made threats on his life.” Bray was the son of Holocaust survivors and wrote about preventing fascism from rising. Established that the International Antifa Defense Fund was not created by defendants and there was no evidence of communication between the Fund and defendants. Noted the crowdfunding could also be used by family and friends, and that defense contractors had attended dinners at Shideler’s organization. Regarding the 2016 video, Shideler could not say who started the conflict.

Attorney McClain (Zachary Evetts): Extracted the key admission: Prior to the September 2025 executive order, the FBI did not designate Antifa as a threat or terrorist organization. No U.S. government agency labeled Antifa as a terrorist organization. Also established that Shideler did not understand the public defender system and did not know how any of the defense attorneys were being paid — some defendants are represented by the public defender’s office, others by court-appointed attorneys, and Evetts used his 401(k). Shideler acknowledged that website content can change and that he did not know which defendants, if any, had seen the videos shown. Defense made the point: “We are held accountable for our own actions, not other members of the group.”

Attorney Tolbert (Savanna Batten): Established that nothing was found in Batten’s apartment during the search except a laptop. Kent had identified Batten as Antifa, but no Antifa materials were recovered from her residence. The EGBC Twitter had 19,100 followers but nobody could confirm who had admin authority. The Antifa Handbook was not connected to any defendant. Tolbert noted the EGBC Twitter page described itself as “an anti-capitalist book club.”

Attorney Hayes (Benjamin Song): Pressed on the relationship between the executive and legislative branches, establishing that Shideler took his definition of Antifa to the Senate and testified he thought it was “a good definition,” while denying he “handcrafted” it. The judge intervened: “Did you handcraft [the] definition of Antifa?” Shideler: “No sir… they shared it… I commented on it.”

The witness was excused after re-cross.

FBI Special Agent Justin Killian — Zachary Evetts’ iCloud

After a break, FBI Special Agent Justin Killian took the stand. Killian has served 7 years with the FBI in Fort Worth on the Joint Terrorism Task Force, handling surveillance, evidence review, and electronic records.

Killian testified about data received from Apple associated with Zachary Evetts’ iCloud backup (tied to his Yahoo email). Exhibits 174 (photos) and 176 (messages and calendar events) were admitted (with page 25 of Exhibit 176 withdrawn after objection).

The iCloud contents included:

  • Screenshots: Google Maps search for Tesla charging in the Alvarado area; aerial view of Prairieland Detention Center and surrounding area
  • SRA Bylaws: Highlighted sections on community defense — “advocates necessary to be effectively armed for self/community defense”
  • “Gear Basics” document (multiple pages): covering black clothing, gas masks, organized bags (“I’ve seen poor organization lead to arrests”), knee and elbow pads (“be water, stay mobile, stay destructive”), body armor recommendations (Kevlar over ceramic for weight; rated 1–4, with items recovered in this case consistently around Level 3)
  • “Gear Tech”: lasers, strobe lights, walkie-talkies; “Phones stay home… metadata lives forever”
  • “Tactics”: Stay in groups; black bloc compared to Tor browser for anonymity; don’t talk to cops; organize jail support; mass tactics referencing Seattle/Portland

Afternoon Session: Agent Killian (Cross-Examination), Agent Clark

FBI Agent Killian — Cross-Examination

Attorney McClain (Zachary Evetts): Established that Killian’s training was in CAST (Cellular Analysis) focused on geolocation, not data extraction, and that he had only rudimentary Cellebrite training. The data was produced by Apple, not extracted by the agent. The “perpetually confused” social media handle could not be tied to Evetts — it came from Discord or Twitter, and there was no evidence Evetts responded to or reacted to any posts. The agent does not use social media and has almost no experience with Twitter. It is possible to scroll past content without reading it, and content loads to phones automatically from apps.

Regarding the black bloc photo: no indication of where the photo originated or who took it. Regarding the text messages: they were from 2021–2022, discussed protests and bringing firearms, but contained no discussion of violence or property damage. No evidence of violence was found at any of the referenced protests.

Regarding the “buy a gun” text: it was sent in response to a political fundraising message about Senator Warnock’s campaign. Defense attempted to establish it could be read as advocating for self-defense. The judge excused the jury, and after argument, stated: “This goes against my ruling, and you’re trying to get in through the back door” — referencing his prior ruling excluding self-defense evidence. However, he allowed the question about whether the text could be an indication of self-defense, to which the agent answered yes.

The agent confirmed: no evidence of violence or property damage at any JBGC cookouts, SRA range days, or other calendar events. These could have been social events or firearms training.

Attorney Luster (Autumn Hill): Established that Autumn Hill moved into the 56th Street residence in 2024, two years after the Evetts text messages. The “these people are scary” text was from August 2022. No evidence of violence at that protest. The “antifa thugs” comment appeared to be sarcasm.

Prosecution redirect: Confirmed that “these people are scary” was “tongue-in-cheek” / sarcastic. Highlighted that Evetts said he “panicked and stayed in his car the whole time” and “felt like a coward.” Showed that screenshots were saved intentionally by the phone user (not auto-generated). The witness was excused subject to recall.

FBI Special Agent Clark — Firearms, Chats, Phone Extractions

Agent Clark was called for a third time. Exhibits 108–119 (firearm transaction records from ATF) were admitted, establishing that Benjamin Song purchased two firearms, including one with a binary trigger, on September 25, 2024.

The EGBC Twitter/X feed (Exhibit 188) was shown: approximately 19,000 followers, last post June 30, 2025, no activity after July 4.

Signal chat evidence from Meagan Morris’ device (Exhibit 153 — “Thursdays” chat):

  • Song: “Gear check this Thursday.” “Can I invite Jon, Wise, and Atrean?”
  • Song sent photos of Prairieland facility to the Thursday chat, including observations about an unmanned guard shack
  • More photos of the Tanglewood area near Prairieland

Exhibit 178 (pp. 1–4, 8–9): Wells Fargo ATM images showing Evetts making a cash withdrawal of $160 on July 4 in Waxahachie (where he lives), wearing the same green clothing from the daytime peaceful protest. This corresponded with a chat message about having money for fireworks.

Cross-Examination of Agent Clark

Attorney Clayton (Maricela Rueda): Established that Rueda’s “rowdy” quote (message 356) had no relation to firearms. Clarified that when Sanchez called Rueda’s phone and drove to her home, Rueda was already in custody and the call did not connect.

Attorney Tolbert (Savanna Batten): Established that of the 19,000+ EGBC posts, only a small fraction were shown in court. Nobody could confirm who made the posts — only that login credentials were found at the Soto residence. Batten’s Fernwood lease ended May 25, 2024 — over a year before July 4, 2025. She was working at Panera Bread in Lake Worth on July 4 (9 AM to 4:45 PM). On the night of July 4, she was at home at a different address. No photos of firearms on her phone. “Is there any direct evidence of a coordinated attack on Prairieland?” — “No, sir.”

Attorney Cofer (Autumn Hill): Identified participants in the new chats — Fun Day Crew (Evetts, Song, Sharp, Rueda, possibly Rel); Response Group (Folkes, Kent, Hill, and others); Support Group (Sharp and others).

Attorney Burns (Elizabeth Soto): Established Liz Soto was not identified in any Signal planning chats. The handle “E” was confirmed not to be Elizabeth Soto. Regarding sticker sales — “Do you think an outrageous sticker would sell better than the boring ones?” — the Sotos were running a business. Raised Sergeant Polsen’s body cam footage where officers initially theorized an ambush. The Sotos’ car was not discovered for three days and was further from the scene than everyone else’s. Established the First Amendment right to protest, at night, wearing whatever they want.

Prosecution redirect: Highlighted that the Sotos’ car was seen passing three times. All phones/devices powered down around the same time (except Baumann’s). The group knew the facility was private property and that fireworks were illegal. Song’s first words when officers appeared: “Get to the rifles” — said twice. The prosecution referenced the “confrontation” and “ambush” language. Objection to the “ambush” characterization was sustained — judge called it “not appropriate.” Agent testified that Song’s iCloud contained tactics for dealing with police but nothing for dealing with counter-protesters.
